
These Terms govern your use of the Hailio mobile app, website, and related services operated by Hailio (Pty) Ltd.

Hailio is a women-first platform. Riders, drivers, and couriers must be female to be activated. Other applicants may sign up but are subject to manual review and may not be activated.
All users must be at least 18 years of age.
You agree to provide accurate information at signup, submit a face photo for verification, and complete any additional verification we request. Misrepresentation of your identity or gender is a material breach of these Terms and grounds for immediate termination.
You agree to treat drivers and couriers respectfully, not bring prohibited items into vehicles, pay all fares, and use the in-app panic button only in genuine emergencies.
To drive or deliver with Hailio you must:
- Be female
- Be at least 18 years of age
- Hold a valid South African driver's licence or appropriate work permit
- Own or have access to a roadworthy vehicle
- Maintain valid vehicle insurance
- Complete our onboarding and verification process
Drivers and couriers are independent contractors, not employees of Hailio. You are responsible for your own taxes, insurance, and vehicle costs.
Riders pay fares through the app. Drivers and couriers receive 80% of each fare, paid out weekly to the bank account they provide. Hailio retains a 20% service fee.
"Take Me Home" is an optional designated-driver service in which a vetted Hailio driver drives you (the "Client") to your chosen destination in your own vehicle, typically with a support vehicle following to collect the driver afterwards. It is not an e-hailing ride in a Hailio driver's vehicle.
The Take Me Home service is not yet available. Any "coming soon" reference in the app or on the website is for information only and does not create an obligation to provide the service. This section governs the service if and when Hailio makes it available to you, and only in areas where Hailio offers it.
- You may use Take Me Home only if you are the registered owner of the vehicle, or are authorised by the owner to permit another person to drive it.
- You warrant that the vehicle is covered by a valid, current motor insurance policy that is in force and that permits an additional or third-party authorised driver to drive the vehicle, including (where applicable) a driver engaged for reward — or that you have obtained your insurer's express written confirmation that this use is covered.
- You are solely responsible for confirming this cover with your own insurer before each trip. Hailio does not provide, arrange, or guarantee insurance for your vehicle and gives no assurance that your policy responds to this service.
- In the event of any accident, loss, or damage to the vehicle or to third parties during the service, your own motor insurance is the primary cover and you will pursue any claim against it. You accept responsibility for any shortfall, excess, or rejected claim, including any rejection arising from a "driving for reward" or "regular driver" exclusion.
Before and during each trip you warrant that: the vehicle is roadworthy, licensed, and lawful to drive on public roads; you have disclosed any pre-existing damage, mechanical defect, or special handling requirement (including whether the vehicle is manual or automatic); and there is no restriction, finance condition, or legal impediment that would make it unlawful or improper for the assigned driver to drive the vehicle. A vehicle condition check may be recorded before and after the trip. Hailio and its drivers are not responsible for pre-existing damage, wear, or mechanical failure that is not directly and solely caused by the driver's proven negligence.
You remain responsible for your own conduct and for anyone you allow into the vehicle. The driver may refuse to start, or may end, a trip without refund if the vehicle is unroadworthy, if you cannot provide valid insurance or authority, or if you or your companions behave abusively, violently, unlawfully, or in a manner that threatens the driver's safety. The service may be used by Clients who are unable to drive (for example after consuming alcohol); this does not transfer responsibility for the vehicle or its insurance to Hailio.
- To the maximum extent permitted by law, Hailio is not liable for damage to your vehicle or its contents, or for loss, injury, fines, tolls, or third-party claims arising from the service, except to the extent directly caused by the gross negligence or wilful misconduct of a Hailio driver.
- Traffic fines, tolls, and penalties incurred during the trip are your responsibility unless caused by the driver's unlawful conduct.
- Hailio is not responsible for cash, valuables, or items left in the vehicle.
- You indemnify and hold Hailio harmless against all claims, losses, damages, fines, and costs arising from (a) any breach of the warranties in this section; (b) inadequate, invalid, or absent insurance on your vehicle; (c) the condition or legal status of your vehicle; or (d) your conduct or that of your companions.
- Nothing in this section limits any liability that cannot be limited under South African law, including under the Consumer Protection Act, 2008.
Take Me Home drivers are vetted by Hailio and hold a valid driving licence for the relevant class of vehicle (including manual transmission where required). Drivers act with reasonable care but are not liable for the matters excluded in this section.
By requesting a Take Me Home trip you confirm that you have read and accept this section and that your vehicle's insurance is valid and permits the assigned driver to drive it.
You may not use the platform for illegal purposes, harass other users, misrepresent your gender, attempt to circumvent the platform for off-platform transactions, or interfere with platform security.
We may suspend or terminate your account for any breach of these terms, misrepresentation, fraudulent activity, or safety risk. You may close your account at any time by following the deletion process on our Account & Data Deletion page.
Hailio provides the platform "as is". We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to fees paid to or by you in the three months prior to a claim. Nothing in this clause limits liability that cannot be limited by South African law, including under the Consumer Protection Act.
These Terms are governed by the laws of South Africa. Disputes will be referred in the first instance to disputes@hailio.co.za. Unresolved disputes will be referred to South African courts or the National Consumer Commission as applicable.
We may update these Terms. Material changes will be notified at least 14 days in advance. Continued use after that period constitutes acceptance.
